1. Acceptance of Terms

By accessing or using the KalHope platform (“KalHope,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use our services.

These Terms apply to all visitors, users, and subscribers of KalHope, including you (“User,” “you,” or “your”).

2. Account Registration & Security

• You must provide accurate, current, and complete information during the registration process.
• You are responsible for maintaining the confidentiality of your password and account credentials. You agree to notify us immediately of any unauthorised use of your account.
• You must be at least 13 years of age to create an account. If you are under 18, you must have the consent of a parent or legal guardian.
• You may not create an account for anyone other than yourself without permission, or use another person's account without their consent.

3. User Conduct & Acceptable Use

You agree not to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Use KalHope for any illegal purpose or in violation of any local, state, national, or international law.
• Interfere with or disrupt the platform, servers, or networks connected to KalHope.
• Attempt to gain unauthorised access to other users' accounts, data, or private workspaces.
• Use any automated means (bots, scrapers, crawlers) to access or collect data from KalHope without our express written permission.
• Upload or distribute viruses, malware, or any other malicious code.

4. User Content & Intellectual Property

Your Content: You retain full ownership of all content you create, upload, or publish on KalHope, including portfolio designs, text, images, code snippets, and other materials (“User Content”).

Licence to KalHope: By posting User Content on KalHope, you grant us a worldwide, non‑exclusive, royalty‑free licence to host, display, and distribute your content solely for the purpose of operating and improving the platform. This licence ends when you delete your content or your account.

Our IP: The KalHope platform, including its software, design, templates, logos, and branding, is owned by KalHope Technology Group and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform without our permission.

5. Payments, Subscriptions & Refunds

• Free Tier: KalHope offers a free Starter plan. No credit card is required.
• Paid Plans: Upgrading to a paid plan (Professional, Enterprise, or Lifetime) gives you access to additional features. All payments are processed securely through Chapa in Ethiopian Birr (ETB).
• Billing: Subscription fees are billed in advance on a monthly or yearly basis, depending on your chosen plan.
• Cancellation: You may cancel your subscription at any time. Your access to paid features will continue until the end of your current billing period.
• Refunds: Refunds are generally not provided for partial subscription periods. If you believe you are entitled to a refund due to a platform error, please contact us within 7 days of the charge.
• Lifetime Plan: The Lifetime plan is a one‑time payment granting you access to all current and future features of the chosen tier for the lifetime of the platform.

6. Affiliate & Referral Programme

KalHope offers an affiliate programme where you can earn commissions by referring new users. Commissions are calculated at a rate of 15% of the referred user's paid subscription and are credited to your affiliate ledger. Payouts are processed via Chapa and are subject to a minimum balance threshold of ETB 500.

We reserve the right to modify or terminate the affiliate programme at any time. Commissions earned prior to any changes will be honoured.

7. Storage & File Hosting

KalHope provides built‑in NVMe storage for Professional, Enterprise, and Lifetime plan subscribers. You may also connect your own Cloudinary account to use the Storage Explorer with your own cloud storage quota. You are solely responsible for the content you upload and must ensure you have the necessary rights to store and share such files.

8. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason in our sole discretion.

You may terminate your account at any time by using the account deletion option in your Settings. Upon termination, your right to use KalHope will immediately cease. We will delete your data in accordance with our Privacy Policy.

9. Disclaimer of Warranties

KalHope is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

We do not warrant that the platform will be uninterrupted, secure, or error‑free, or that any defects will be corrected.

10. Limitation of Liability

In no event shall KalHope Technology Group, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the platform, whether based on warranty, contract, tort, or any other legal theory.

Our total liability to you for any claim arising out of these Terms or your use of KalHope shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless KalHope Technology Group and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or relating to your violation of these Terms or your use of the platform.

12. Third‑Party Links & Services

KalHope may contain links to third‑party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third‑party sites.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ethiopia, without regard to its conflict of law provisions. Any disputes arising out of these Terms shall be resolved in the courts of Addis Ababa, Ethiopia.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a notice on our platform. Your continued use of KalHope after changes become effective constitutes your acceptance of the new Terms.
